If you apply online, please visit or call the County Clerk's office at least three days before your ceremony to complete the license process.

There are no exceptions or waivers to the license fee. No extensions or refunds are made once the license is issued. There is a three-day waiting period from the day the license is issued until it can be used. The license is only good in the State of Oregon for 60 days from the effective date. Legal age for marriage in the State of Oregon is 18 years of age.
Anyone not yet 17 years of age cannot be legally married in the State of Oregon. A seventeen year-old can be married if they have the parent's or guardian's consent. Parent and guardian consent forms are available from the Deschutes County Clerk's office.
Medical examinations and blood tests are not required. Blood tests are recommended if you plan on having children.
Please allow approximately 20 minutes to obtain a license. If you complete the Marriage License application form online ahead of time, please allow 5-10 minutes. These times are approximate and dependent on our lobby wait time.
Currently, there are no public officials (judges, justice of the peace) who perform ceremonies on a regular basis at the courthouse. in Deschutes County. You obtain your license from The County Clerk's office and are then responsible for finding your own officiant.

Identification: Both parties provide identification issued by a state or federal agency, showing both photo and date of birth. Be sure to account for Certified Copies ($4 each).
The parties to the marriage will need to identify on the application the legal names they will be taking after the marriage, this is when you originally apply for the Marriage License.
A license can be issued one day after the final date of a divorce.
Oregon state law does not allow the marriage of first cousins or nearer kin. Oregon state law does not allow married people to get married again without a legal divorce.
Once the license is effective, it is valid for a 60-day period.
Once the marriage has taken place, and the completed marriage license is returned to the Deschutes County Clerk, an official certified copy of the license can be obtained from the County Clerk for $4.00 a piece. You may want to order more than one. The official certified copy is used to change your name on all official documents.
The certified document is considered the legal copy, and can be used by the applicants to change their name on items like a driver's license or social security card. This will be mailed to the address on the marriage license application within 5-10 business days.
A decorative marriage certificate will be provided by the County Clerk's office. This is not a legal document and may not be used as proof of marriage. If an issued license is lost or destroyed, it can be replaced at the County Clerk’s office.
106.120 Who may solemnize marriage; fee; personal payment; records. (2) Marriages may be solemnized by: (a) A judicial officer; (b) A county clerk; (c) Religious congregations or organizations as indicated in ORS 106.150 (2); or (d) A clergyperson of any religious congregation or organization who is authorized by the congregation or organization to solemnize marriages. (3) A person authorized to solemnize marriages under subsection (2) of this section may solemnize a marriage anywhere in this state.
The state of Oregon shows no desire to delve into the minutiae of wedding planning, leaving it to couples to determine the form and substance of any ceremony according to established rituals; provided, of course, that it takes place in the physical presence of the couple, the minister and at least two witnesses. That being said, both members of the couple must at some point declare that they take each other to be spouses in a marriage, and have that consent pronounced by the minister.
Every marriage license granted in Oregon will state that neither individual entering in the marriage will become the property of the other, allowing each to live in a union free from violence and abuse. Applicants are legally forbidden from intentionally making false claims in any section of the application.
The state of Oregon requires that the minister return the original application, marriage license and record of marriage to the same county clerk of issuance, making sure to list their title and the name of the relevant church along with the organization's address.
